2. Purpose and acceptance
These terms and conditions govern access to and use of the Paddock technology platform (hereinafter, "the Platform"), which connects drivers with verified automotive workshops and independent mechanics. Accessing or using the Platform implies full and unconditional acceptance of these terms. If you disagree, you must refrain from using the Platform.
3. Service description
Paddock is a technology platform that offers:
- Connection between drivers and verified workshops/mechanics.
- Automotive service scheduling.
- Vehicle history recording and consultation.
- Workshop comparison by rating, price, and location.
- Parts and services marketplace (coming soon).
- Mobile mechanic service requests.
4. Legal nature of Paddock
Paddock acts exclusively as a technology intermediary between drivers and automotive service providers (workshops and mechanics). Paddock is NOT a workshop, does NOT provide mechanical services directly, and does NOT assume responsibility for the quality, suitability, or outcome of services provided by third parties through the Platform. The contractual relationship for automotive service provision is established directly between the driver and the workshop or mechanic.
5. Registration and user accounts
To access Platform features, the user must:
- Be over 18 years of age and have legal capacity to contract.
- Provide truthful, complete, and up-to-date information.
- Maintain the confidentiality of their access credentials.
- Immediately notify any unauthorized use of their account.
6. User obligations
Users agree to:
- Use the Platform in accordance with the law, morality, and public order.
- Not publish false, misleading, or deceptive information.
- Not impersonate third parties.
- Not reverse engineer, decompile, or attempt to access the source code.
- Not interfere with the normal operation of the Platform.
- Not use the Platform for illegal activities or activities contrary to these terms.
- Respect the intellectual property rights of Paddock and third parties.
7. Workshop and mechanic obligations
Workshops and mechanics registered on the Platform additionally agree to:
- Hold the licenses, permits, and insurance required by Colombian regulations.
- Provide services with the diligence and quality offered.
- Comply with the legal warranty on services provided (Law 1480 of 2011).
- Keep their contact information and availability up to date.
- Not contact users outside the Platform to evade commissions.
8. Workshop and mechanic verification
Paddock performs a verification process for workshops and mechanics that register on the Platform. However, this verification does not constitute an absolute guarantee of service quality. Users should exercise their own judgment when selecting a service provider.
9. Payments and commissions
Payments made through the Platform are processed through payment gateways authorized by the Colombian Financial Superintendence. Paddock may hold payment until the driver confirms satisfaction with the service, within established timelines. Paddock charges a commission per successful transaction, which will be transparently disclosed before confirming the service.
10. Warranty and payment reversal
In case of dissatisfaction with the service provided, the driver may request Paddock mediation within 48 hours following service completion. Paddock will facilitate communication between parties but does not assume direct responsibility for conflict resolution. The right of withdrawal applies in accordance with Law 1480 of 2011 (Consumer Statute).
11. Intellectual property
All Platform content — including but not limited to brand, logos, design, source code, text, images, and databases — is the exclusive property of Paddock Enterprise S.A.S. and is protected by Colombian and international intellectual property laws. Reproduction, distribution, or modification without written authorization is prohibited.
12. Limitation of liability
Paddock shall not be liable for:
- Damages arising from service provision by workshops or mechanics.
- Service interruptions due to force majeure or fortuitous events.
- Data loss due to causes beyond Paddock's control.
- Content published by users that is false or inaccurate.
- Decisions made by users based on Platform information.
13. Suspension and termination
Paddock reserves the right to suspend or cancel user accounts that violate these terms, without prior notice and without generating any right to compensation. Users may cancel their account at any time through the Platform or by requesting it at hola@paddockent.com.
14. Personal data protection
Personal data processing is governed by our Personal Data Processing Policy, prepared in accordance with Law 1581 of 2012 and Decree 1377 of 2013.
15. Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Colombia. For dispute resolution, the parties submit to the jurisdiction of the courts of Bogotá D.C., Colombia, after exhausting alternative dispute resolution mechanisms.
16. Modifications
Paddock reserves the right to modify these terms at any time. Modifications will be notified to registered users at least ten (10) business days prior to their effective date. Continued use of the Platform after notification constitutes acceptance of the new terms.
